Practical Analysis of the 2008 Tax Reform:
During recent years, specifically through 2002 and 2005, crucial changes have been experienced in Mexican taxation system. In 2002 major amendments were made to the income tax and value added tax laws, especially in changing the system of accumulation and taxation based on cash flow. In 2005 we returned to a cost calculation of sales in order to determine the tax result of a corporation. This was an unprecedented reform, considering that since 1987, the companies had been considering their purchases 100% deductible during the year. By 2008 the new “Flat Rate Business Tax Law”(IETU) was published. This new tax is imposed on corporations and persons for certain acts and / or activities they undertake on a different basis than of the Law of Income Tax. The authors dealt with this new law in a practical manner.
2007 Tax Reform:
We refer to Kim Quezada’s ® tenth anniversary and a remembrance to the events that marked our institution. In this reform package, the Congress is concerned more about promoting the social wellbeing and the respect to human rights during the tax proceedings. It addresses the concern that the public officials may be tempted to take advantage of their powers and commit abuses against the taxpayers. It tries to insure that the taxpayer is less likely to offer bribes. New rules were established intended to give a clean slate to taxpayers with debts, and above all, lighten the load of the Mexican justice system, recognizing the existence of thousands of lawsuits pending resolution and therefore maintaining the bureaucratic system immersed in the past. This reform produces important rules for the agricultural sector.
2005 Tax Reform:
Until 1986 the cost of sales was deductible for tax purposes. In 1987 and 1988 we saw a transition regimen that conducted to a system of full purchase deduction. This is due to the excessive inventory depreciation caused by a high inflation rate that was experienced in those years. In 2005, the system of deducting purchases is canceled, under the argument of having a single-digit inflation and that companies were financing themselves through tax deferment by purchasing goods in excess. The book addresses a series of reforms that took place in the income tax law, mainly due to the return to the cost of sales system as one of the most important deductible items for the entire company.
Practical Applications of the 2004 tax reforms:
The approach is entirely innovative. It discusses the fiscal reforms that came into effect since January 2004 in a friendly to read material with several examples for better understanding. In this exercise various provisions that were vague and unclear are accurately explained. The universal offsetting of balances in favor is permitted; until 2003 a tax offset was only accepted between the same types of tax. This is a light and practical book that reviews the reforms through its more than 200 pages.
2004 Annual return for corporations:
In March 2005, we again publish a practical analysis of the preparation and presentation of the 2004 annual return. It introduces new concepts enforced by the 2004 reform and it incorporates these subjects to a practical case study. This work led to many courses throughout the Northeast Region, sharing our knowledge of this research with other accountants and persons engaged in the administration of companies in a practical and enjoyable manner. It was also used as a manual in a series of training courses for our technical staff during 2005.
2003 Annual return for corporations:
In February 2004 the authors published a step by step case study that leads the reader to determine the outcome of the fiscal year result in income tax terms, value added tax reconciliations, calculation of the asset tax and completion of the tax form. The analysis addresses the various options contained in the law which provided benefits to taxpayers. It presents charts and explanatory schemes to evaluate all options and clarify the interpretation of the fiscal policy.
2002 Tax Reform:
This year produced high-impact reforms in the Value Added Tax Law (VAT). It was necessary to establish accounting procedures for the control of the tax basis of cash flow, as until that time, it had been difficult to maintain those bases properly reconciled at the end of every month. It comprehensively examines the tax reform, giving relevance to the moment of accumulation for tax purposes.
2002 Fiscal Reform Workshop:
Due to the complexity of the tax reform, the authors decided to write a book based on case studies to be presented in a series of lectures to readers of our profession. We address from several points of view the new VAT Law and in general any tax reform applicable to this year. It is a simple and enjoyable book which consists of 119 pages that helps the reader to understand the system of VAT, up to determining the final monthly payments.
2000 Tax reform:
It contains several reforms to tax laws, focusing on: • Simplifying the tax system and strengthening the legal security of the taxpayer. • A battle against tax evasion and tax avoidance. • Aligning the tax provisions to the economic environment • Strengthening of the Fiscal Federalism These points are analyzed by the authors who express their expert opinions.
1999 Tax reform:
Extremely difficult year for the executive. Parliamentary fractions were not in agreement. A failed and low impact tax reform was obtained. The reforms are more focused on form and not on substance.
